Department of Defense for “Shipbuilding and Conversion, Navy” may apportioned the rate for operations necessary for Columbia Class Submarine not to exceed $1,601,805,000.00.

Department of Defense under heading “Operation and Maintenance” for emergencies and extraordinary expenses for purposes the Secretary of Defense or the Secretary of the Navy, determines to be proper with regard to the disruption of the water supply near Red Hill Bulk Fuel Storage Facility, on O’ahu Hawaii in accordance not to exceed $53,000,000.00. Provided that 30 days after the enactment of this Act the Secretary of Defense submits a report to the Committee of Appropriations of the House of Representatives and Senate, set forth amounts of obligations and expenditures. In addition to the amounts provided by this Act, appropriations to the Department of Defense $250,000,000.00 to address drinking water contamination at the Red Hill Bulk Fuel Storage Facility in Hawaii specified::

Military Personnel Army $33,263,000.00 available until September 30, 2022

Military Personnel Navy $91,327,000.00 available until September 30, 2022

Military Personnel Marine Corps $5,206,000.00 available until September 30, 2022

Military Personnel Air Force $27,564,000.00 available until September 30, 2022

Operations and Maintenance Army $22,640,000.00 available until September 30, 2022

Operations and Maintenance Navy $70,000,000.00 available until September 30, 2022

In addition to amounts provided by this Act, appropriated Department of Defense $100,000,000.00 for additional amount for fiscal year 2022 to be available until expended for transfer to accounts under “Operation and Maintenance”, “Procurement”, “Research, Development, Test and Evaluation”, “Defense Working Capital Development” for the Secretary of Defense to conduct activities compliant to State of Hawaii Department of Health Order 21-UST-EA-02 December 6, 2021. This order is for the removal of fuel from and improvement of infrastructure at the Red Hill Bulk Fuel Storage Facility.

Provided: Transfer authority provided is in addition to any other transfer authority available to the Department of Defense.

Provided further: Amounts provided in this subsection shall NOT be available for transfer, obligation, or expenditure until Secretary of Defense briefs Committees on Appropriations of the House of Representatives and Senate regarding third party assessments of the operations and systems integrity of Red Hill facility and Department’s own analysis on distribution of fuel reserves for operations in the Pacific theatre.

Provided further: No later than 15 days after the transfer of funds, the Secretary of Defense will notify the congressional defense committee details of any transfer.

Provided further: No later than 60 days after the date of enactment of this Act and 30 days after fiscal year 2023 the Secretary of Defense will submit a report to the Committee on Appropriations of the House and Senate setting all categories and amounts of obligations and expenditures.

Amounts made to the Department of the Interior under “Working Capital Fund” may be appropriated for operations to implement enterprise cybersecurity safeguards.

Statutory PAYGO Scorecard: The budget effects for this division will NOT be entered in PAYGO scorecard of the Statutory Pay-As- You-Go Act of 2010.

Senate PAYGO Scorecard: The budget effects for this division will NOT be entered in PAYGO scorecard maintained for purposes 4106 of H. Con. Res. 71. Notwithstanding, Rule 3 of the Budget Scorekeeping Guidelines set by Conference Report (105-217) and section 250(c)(8) of the Balanced Budget and Emergency Deficit Control Act of 1985. The Budget effects shall NOT estimate the purposes of section 251 of such Act and for purposes allocation to the Committee on Appropriations section 302(a) of Congressional Budget Act of 1974 and purposes of paragraph (4)(C) section 3 of Statutory Pay-As-You-Go Act of 2010.
